It was the logical next step of the ultra-conservatives…to control and ultimately destroy the internet’s neutrality.
There is an effort going almost unnoticed to regulate and bring censorship to the internet. If we ask ourselves why this is happening all you have to do is to look at the influence and control that the wealthy and the ultra right conservatives have over traditional media. They are so visible and so thorough they cover from radio (using radical right wing pundits) to running a network that is practically a branch of the Republican Party: FOX NEWS.
But they have been unsuccessful in controlling what individual blogs say or what those bloggers do. We have seen how it is possible to mobilize hundreds of thousands of people to protest and demonstrate as is the case with Occupy Wall Street. It is a grassroots movement that is intricately tied to the ability of people to communicate through the internet. Obviously, the establishment, that 1% who owns and control the wealth have no stomach for freedom of speech because it represents a threat to their plans to establish a theocratic-plutocracy.
“The Federal Communications Commission’s “Open Internet” rules — also known as net neutrality — took effect Sunday, after a year-long battle in Congress. Some market-based technology experts, however, have expressed doubt that the rules will be upheld when the case comes before the federal appellate court in 2012.
Supporters of net neutrality argue that Internet service providers should not be allowed to exercise preferential treatment of data in the management of their network traffic because that is a threat to free speech. Opponents of the FCC’s net neutrality rules contend that the FCC lacks the proper authority to regulate the Internet, and that the rules are a threat to the innovation and economic growth it has experienced.
Friday, three free market technology experts explained to Media Freedom, a market-based tech policy organization, their doubts over the longevity of the FCC’s rules.
“I do believe it is likely that the FCC’s action will be overturned in the [Washington,] D.C. circuit,” said Randolph May, president of Free State Foundation. May said that the FCC “exceeded its statutory jurisdiction,” and that the legal arguments the agency made during a similar case in 2010, involving Internet service provider Comcast, were rejected by the same D.C. court set to hear the new case.
“The court is gonna see that the FCC is doing a huge overreach,” said Scott Cleland, president of NetCompetition. “The logic that the FCC has would basically allow it to regulate anything with an Internet chip in it. It could be a washing machine, it could be anything.”
The FCC is trying to regulate through the “Open Internet” rules Cleland said, but the FCC misinterpreted the law it claims gives them the authority to do so.
“It’s going to be quite clear to the court that they don’t have existing authority,” Cleland added, “and when they try and bootstrap it with the authority they describe right now, I think the court is gonna chuckle and say, ‘Nice try, but no way!’”
What disturbs most people the most is the implied ability to just go in and close a blog whenever somebody doesn’t like what it is saying. All that is needed is a complaint and the blog goes dark. That is what this “SOPA” or Protect IP by actually blocking web sites without redress or any explanation…all that is needed is a complaint…and you know there are going to be plenty of those coming from the political ultra-right and from religious fanatics.
Website Blocking
If SOPA or Protect IP passes, the government can order internet providers to block any site for its users' infringing posts, using the same DNS-blocking methods as China or Iran.
Risk of Jail for Ordinary Users
It becomes a felony with a potential 5 year sentence to stream a copyrighted work that would cost more than $2,500 to license, even if you are an ordinary noncommercial user. Singing a pop song on Facebook could be a felony.
Chaos for the Internet
Thousands of sites that are legal under the DMCA would face new legal threats. People trying to keep the internet more secure wouldn't be able to rely on the integrity of the DNS system.
